Terms of Service

Our terms and conditions

These Terms of Service (the "Terms") are a binding agreement between you and Pumice Press (Christians Thrive Trust, "Pumice Press," "we," "us," or "our") governing your access to and use of pumicepress.com, our books and digital content, our AI-powered book-interaction tools, and any other products or services we offer (collectively, the "Services").

PLEASE READ CAREFULLY. Section 14 contains an arbitration agreement and class-action waiver that affect your legal rights. You may opt out of arbitration within 30 days as described in Section 14.5.

1. Acceptance of These Terms

By accessing or using the Services, creating an account, purchasing a book, or otherwise interacting with us, you agree to be bound by these Terms and our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the Services.

2. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to create an account or make a purchase. By using the Services you represent that (a) you meet the age requirement, (b) you have the legal capacity to enter into these Terms, and (c) your use of the Services does not violate applicable law. We do not knowingly permit anyone under 13 (or under 16 in the EEA / UK) to use the Services.

3. Accounts and Account Security

  • You are responsible for the accuracy of the information you provide when registering.
  • You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account.
  • You must notify us promptly at hello@pumicepress.com of any unauthorized use of your account or other breach of security.
  • We may suspend or terminate accounts that violate these Terms or that we reasonably believe pose a security or compliance risk.

4. Books, Digital Content, and Purchases

  • Pricing and availability. Prices, availability, and content descriptions may change without notice. We reserve the right to correct typographical errors and refuse or cancel orders affected by such errors.
  • License to digital content. When you purchase or access digital content from Pumice Press, we grant you a personal, non-exclusive, non-transferable, revocable license to access and use that content for your personal, non-commercial use, subject to these Terms.
  • Restrictions. You may not redistribute, resell, copy, sublicense, or remove proprietary notices from any of our content, except as expressly permitted by law.
  • Refunds. Our refund practices for direct purchases are described at checkout or in your order confirmation. Purchases made through Amazon (including KDP- published titles) are governed by Amazon's policies.

5. AI-Powered Book Tools

The Services include features that allow you to ask questions, request summaries, generate insights, and otherwise interact with content from our books and related materials using artificial intelligence (the "AI Features"). Your use of the AI Features is subject to the following:

  • AI outputs are generated and may be inaccurate. Outputs are produced by statistical models and may contain errors, omissions, or fabricated information. They are not a substitute for professional advice (legal, medical, financial, or otherwise), and you are responsible for independently verifying any output before relying on it.
  • No advice relationship. Use of the AI Features does not create any professional, fiduciary, or advisory relationship between you and Pumice Press.
  • Permissible inputs. You agree not to submit (a) personal data of others without authorization, (b) sensitive data such as government-issued identifiers, financial-account numbers, or full health records, (c) content you do not have the right to submit, or (d) content that violates Section 7 (Acceptable Use).
  • Output ownership. Subject to the rights of third parties (including underlying book content), generated outputs from the AI Features are made available to you for your personal, non-commercial use. AI outputs may not be unique to you, may resemble outputs generated for other users, and may incorporate or paraphrase content that is protected by copyright. You are responsible for your use of any output.
  • Service-improvement use. We may use de-identified or aggregated data derived from interactions with the AI Features to operate, secure, debug, and improve the Services. We do not authorize public-model training on your inputs as described in our Privacy Policy.
  • Quotas and abuse prevention. We may apply rate limits and other restrictions to prevent abuse, ensure availability, and control costs.

6. Communications — Email, SMS, and Phone

  • Consent. By providing your email address or phone number and opting in, you consent to receive communications from us, including transactional messages, account notifications, and (where applicable) marketing messages by email, SMS, or phone, including via automated dialing systems and prerecorded or artificial voices.
  • Not a condition of purchase. Consent to marketing communications is not required to purchase any product or service.
  • Frequency and rates. Message frequency varies. Standard message and data rates may apply.
  • Opting out. You can unsubscribe from marketing email by clicking "unsubscribe" in any email, opt out of marketing SMS by replying STOP to any message, or opt out of marketing calls by emailing hello@pumicepress.com. Reply HELP to any SMS for help. Even after opting out, you may continue to receive transactional and service-related communications.

7. Acceptable Use

You agree not to (and not to permit anyone else to):

  • Violate any applicable law, regulation, or third-party right.
  • Upload, post, transmit, or otherwise make available any content that is unlawful, harassing, defamatory, abusive, hateful, threatening, sexually explicit involving minors, or otherwise objectionable.
  • Use the Services to generate, distribute, or train models on outputs in a manner that misrepresents AI-generated content as human-authored where such misrepresentation is prohibited.
  • Attempt to reverse engineer, decompile, scrape, or extract the source code, training data, or model weights underlying any part of the Services.
  • Probe, scan, or test the vulnerability of the Services without our written permission.
  • Interfere with, disrupt, or impose an unreasonable load on the Services or the networks connected to them.
  • Use the Services to develop a competing product or to benchmark the AI Features for the purpose of building a competing model.
  • Bypass, disable, or circumvent any rate limits, security, or access controls.
  • Use any automated means (bots, crawlers, scrapers) to access the Services other than as expressly authorized by us in writing or by our robots.txt.
  • Submit content that infringes copyrights, trademarks, or other intellectual-property rights, or that contains malware or other harmful code.

8. Intellectual Property

The Services, including all books, written content, software, trademarks, logos, graphics, design, and look-and-feel, are owned by Pumice Press or its licensors and are protected by copyright, trademark, and other intellectual-property laws. We grant you a limited, personal, non-exclusive, non- transferable, revocable license to access and use the Services as expressly permitted by these Terms. All rights not expressly granted are reserved.

9. User Content and Feedback

If you submit comments, reviews, suggestions, ideas, or any other materials to us (including Reader Inputs to the AI Features) ("User Content"), you grant Pumice Press a worldwide, perpetual, irrevocable, royalty-free, sublicensable, and transferable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display the User Content for the purpose of operating, improving, and promoting the Services, subject to the additional limits in our Privacy Policy. You represent and warrant that you have the rights necessary to grant this license and that your User Content does not violate the rights of any third party or applicable law.

10. Affiliate and Third-Party Disclosures

  • Amazon Associates. Pumice Press is a participant in the Amazon Services LLC Associates Program, an affiliate advertising program designed to provide a means for sites to earn advertising fees by advertising and linking to Amazon. As an Amazon Associate we earn from qualifying purchases. Some links on the Site are affiliate links; clicking them and completing a qualifying purchase may result in a commission to us at no extra cost to you.
  • Amazon and KDP purchases. Books published by Pumice Press through Amazon Kindle Direct Publishing are sold and fulfilled by Amazon, subject to Amazon's terms and policies. Issues such as delivery, returns, and refunds for Amazon orders should be directed to Amazon.
  • Other third-party services. The Services may contain links to or integrations with third-party websites and services. We do not control and are not responsible for any third-party content, products, or services. Your use of third-party services is governed by their terms and policies.

11. Disclaimers

The Services, including the AI Features, are provided "as is" and "as available," without warranties of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement, and any warranties arising out of course of dealing or usage of trade.

We do not warrant that the Services will be uninterrupted, timely, secure, or error-free; that defects will be corrected; or that the Services or the servers that make them available are free of viruses or other harmful components. Outputs from the AI Features may be inaccurate and are not professional advice. Some jurisdictions do not allow the exclusion of certain warranties; in those jurisdictions, the foregoing exclusions apply to the maximum extent permitted by law.

12. Limitation of Liability

To the maximum extent permitted by law, in no event will Pumice Press, its affiliates, officers, directors, employees, agents, or licensors be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to lost profits, lost revenue, lost data, business interruption, or loss of goodwill, arising out of or relating to these Terms or your use of the Services, whether based on contract, tort (including negligence), strict liability, or any other theory, even if we have been advised of the possibility of such damages.

Our aggregate liability for all claims arising out of or relating to these Terms or the Services will not exceed the greater of (a) the amounts paid by you to Pumice Press in the 12 months preceding the event giving rise to the claim, or (b) one hundred U.S. dollars (US $100). Some jurisdictions do not allow the limitation or exclusion of liability for incidental or consequential damages; in those jurisdictions, the foregoing limitations apply to the maximum extent permitted by law.

13. Indemnification

You agree to defend, indemnify, and hold harmless Pumice Press, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or relating to (a) your use or misuse of the Services, (b) your User Content, (c) your violation of these Terms, or (d) your violation of any law or third-party right.

14. Dispute Resolution — Arbitration and Class-Action Waiver

14.1 Informal Resolution

Before filing a claim, you agree to try to resolve the dispute informally by contacting us at hello@pumicepress.com with a written notice describing the claim and the relief you seek. We will try in good faith to resolve the dispute within 60 days of receiving your notice.

14.2 Binding Arbitration

If we cannot resolve a dispute informally, you and Pumice Press agree that any dispute arising out of or relating to these Terms or the Services (a "Dispute") will be resolved by binding individual arbitration administered by a recognized arbitration provider (such as the American Arbitration Association or, for users outside the U.S., a comparable provider in the user's jurisdiction) under its then-current consumer arbitration rules. The arbitrator has exclusive authority to resolve all threshold issues of arbitrability.

14.3 Class-Action and Jury Waiver

You and Pumice Press each waive the right to a trial by jury and the right to participate as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding. The arbitrator may not consolidate more than one person's claims and may not preside over any form of representative or class proceeding.

14.4 Exceptions

Either party may bring a claim in small-claims court if it qualifies, and either party may seek temporary injunctive relief in a court of competent jurisdiction to protect intellectual-property rights or prevent unauthorized access to the Services pending arbitration.

14.5 30-Day Right to Opt Out

You may opt out of the arbitration agreement and the class- action waiver in this Section 14 by sending written notice of your decision to opt out to hello@pumicepress.com within 30 days after you first accept these Terms. The notice must include your full name, the email address associated with your account, and a clear statement that you wish to opt out of the Pumice Press arbitration agreement. Opting out will not affect any other portion of these Terms.

15. Governing Law and Venue

These Terms and any Dispute will be governed by the laws of the State of Wyoming, U.S.A., without regard to its conflict of laws principles. Subject to Section 14, the state and federal courts located in Laramie County, Wyoming (including the Wyoming Chancery Court for qualifying commercial matters) will have exclusive jurisdiction over any matter not subject to arbitration, and you consent to the personal jurisdiction of those courts. If you access the Services from a country whose mandatory consumer-protection laws cannot be displaced by contract, those laws will apply to the extent required.

16. Termination

You may stop using the Services and close your account at any time. We may suspend or terminate your access to all or any part of the Services at any time, with or without notice, if we believe in good faith that you have violated these Terms or that suspension or termination is necessary to protect Pumice Press, our users, or third parties. Sections that by their nature should survive termination (including Sections 8, 9, 11, 12, 13, 14, 15, and 17) will survive.

17. Changes to These Terms

We may update these Terms from time to time. When we make material changes we will post the updated Terms here with a new "Last updated" date and, where required, provide additional notice. Your continued use of the Services after the effective date constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Services.

18. Miscellaneous

  • Entire agreement. These Terms, together with the Privacy Policy and any other policies referenced here, constitute the entire agreement between you and Pumice Press regarding the Services.
  • No waiver. Our failure to enforce any provision is not a waiver of the right to enforce it later.
  • Severability. If any provision is held unenforceable, the remaining provisions will remain in full force, and the unenforceable provision will be modified to the minimum extent necessary to make it enforceable while preserving its intent.
  • Assignment. You may not assign these Terms without our prior written consent. We may assign these Terms to an affiliate or in connection with a merger, acquisition, or sale of assets.
  • Relationship. Nothing in these Terms creates any agency, partnership, joint venture, or employment relationship between you and Pumice Press.
  • Notices. We may provide notices to you by email, in-product notification, or by posting on the Site. You may provide notices to us at hello@pumicepress.com.
  • Force majeure. We are not liable for any delay or failure to perform caused by events beyond our reasonable control.
